Summary – Odporca preukázateľne porušil tarifné a prepravné podmienky, za ktorých použil dopravný prostriedok navrhovateľa a vznikla mu povinnosť, pretože cestoval bez platného cestovného lístka, zaplatiť hodnotu cestovného a osobitnú sankciu ustanovenú zákonom. Toto odporca neučinil, a preto návrh navrhovateľa bol podaný dôvodne a preto mu súd v plnom rozsahu vyhovel.
