Summary – Označený odporca nemal právnu subjektivitu už v čase podania návrhu, pretože preukázateľne pred podaním návrhu zomrel. Teda nemal spôsobilosť mať práva a povinnosti a tým nemal spôsobilosť byť účastníkom konania. Táto nesplnená podmienka konania bola neodstrániteľná, preto súd konanie podľa § 104 ods. 1 O. s. p. zastavil.
