Summary – Iba tvrdenie navrhovateľa o tom, že odporkyňa včas a riadne neuhradila faktúry, bez toho, aby predložil dôkazy, ktoré konkrétne faktúry odporkyňa neuhradila, resp. uhradila omeškane, nie je postačujúce, pričom je nutné urobiť záver, že navrhovateľ v konaní neuniesol dôkazné bremeno na preukázanie ním tvrdených skutočností. Vzhľadom na uvedené, musel súd návrh navrhovateľa zamietnuť.
