Summary – Keď účastníci uzavreli poistnú zmluvu podľa § 6 zákona a žalovaný na poistenie na rok 2009 nezaplatil druhú, tretiu a štvrtú splátku (na kalendárne štvrťroky) a to ani napriek výzve žalobcu, poistenie zaniklo podľa § 9 ods. 4 zákona pre nezaplatenie poistného do jedného mesiaca od dátumu splatnosti celého poistného (poslednú splátku mal zaplatiť 01. 10. 2009) , kedy poistenie zodpovednosti zaniká uplynutím tejto lehoty, teda dňom 01. 11. 2009.
