Summary – Keď účastníci uzavreli poistnú zmluvu podľa § 6 zákona a žalovaný na poistenie nič nezaplatil, pričom poslednú splátku poistného na 1 rok mal zaplatiť 25. 11. 2009 a neurobil tak ani napriek výzve žalobcu, poistenie zaniklo podľa § 9 ods. 4 zákona pre nezaplatenie poistného do jedného mesiaca od dátumu splatnosti, kedy poistenie zodpovednosti zaniká uplynutím tejto lehoty, teda dňom 25. 12. 2009.
