Summary – Keď žalobu na zaplatenie podal na súd až 13. 07. 2011, teda po uplynutí trojročnej premlčacej doby, ktorá začala plynúť od splatnosti jednotlivých faktúr, súd žalobu podľa § 100 ods. 1 a § 101 Obč. zák. z dôvodu premlčania zamietol. Tak isto zamietol žalobu z dôvodu premlčania aj pokiaľ ide o zmluvnú pokutu vo výške 6,64 eur.
