Summary – Keď nebolo preukázané, že by žalovaný ako dlžník v čase uznania záväzku bol mal vedomosť o tom, že dlh je už premlčaný, nenastali účinky predĺženia premlčacej doby, a preto keď žalovaný a vedľajší účastník vzniesli námietku premlčania, súd žalobu podľa § 100 ods. 1 Obč. zák. zamietol.
